Terms and Conditions for Rental Property Owners

Welcome to our service! These Terms and Conditions outline the rules and obligations that govern your use of our services. By using our services, you agree to comply with these Terms. Please read them carefully.

 

These terms and conditions only apply to guests that is/was “referred” by us to respective owners

 

Non-Disclosure Obligations:

 

  1. The Owner agrees not to discuss or disclose any information regarding the financial terms, revenue, or profits associated with the rental property or the business relationship with Rent Baguio.
  2. The Owner shall not discuss or disclose any financial information or profit details to any guests or potential guests.
  3. The Owner agrees not to offer discounts, coupons, or incentives to guests in exchange for longer stays, reservations, or any other favor related to the rental property without prior written consent from Rent Baguio.

 

Guests’ Booking Terms and Conditions:

 

  1. Guests referred to owners by Rent Baguio are considered our guests. If our guests wish to book the owners’ properties, they must do so through our platform.
  2. Owners are strictly prohibited from providing any exclusive deals, promotions, coupons, or discounts to our guests without Rent Baguio’s consent.
  3. Owners cannot book our guests directly or refer them to different properties without Rent Baguio’s consent.
  4. Violation of this booking agreement will result in the termination of this contract, and Rent Baguio will cease to work with the owners.

 

Liability for Damages:

 

  1. Rent Baguio is not responsible for any damages caused by guests to the properties owned by the owners.
  2. Guests will be held fully responsible for any damages caused by their actions during their stay.
  3. Rent Baguio will provide proper documentation to the owners should they wish to pursue legal actions against the guests for incurred damages.

 

Owner’s Cancellation Policy:

 

  1. Owners have the right to cancel a reservation at any time before check-in, provided they give at least 2-3 hours’ notice.
  2. In case of owner cancellation, guests will be entitled to a 100% refund as per Rent Baguio’s refund policy.

 

Safety and Property Issues:

 

  1. In the event of a natural disaster or unforeseen issues affecting the properties, it is the owners’ responsibility to ensure the safety of guests or make necessary adjustments.
  2. Owners must promptly notify Rent Baguio of any actions taken in response to such circumstances.

 

Owner’s Right to Accept or Reject Guests:

 

  1. Owners have the full right to accept or reject any guests for their properties before check-in.
  2. If an owner rejects a guest, the guest will be entitled to a 100% refund.

 

Owner’s Right to Ask Guests to Leave:

 

  1. Even after check-in, the owners retain the right to ask a guest to leave the property with a valid reason.
  2. In such cases, the guest will not be entitled to any refund, including the reservation fee.

 

Prohibited Activities:

 

  1. Engaging in any illegal activities or violating the rules and regulations of the Philippines within the properties is strictly prohibited.
  2. In case of such activities, the owner may ask the guest to leave the property and seek assistance from law enforcement authorities, such as the police. The owner can also pursue further legal actions against the guests.
  3. Rent Baguio shall not be held responsible for any illegal activities conducted by guests staying in the properties.

 

Payment:

 

  1. All balances shall be paid during check-in. The owners shall be responsible for collecting the payment. If there is any remaining balance left by the guest, it must be settled directly with the owners.
  2. If a guest extends their stay with the owner, the owner must notify Rent Baguio and a new updated invoice shall be issued.

 

Maintenance and Repairs:

 

  1. Owners are responsible for maintaining the properties in a safe and habitable condition for guests.
  2. Owners should promptly address any necessary repairs or maintenance issues that may arise during a guest’s stay.

 

Communication and Cooperation:

  1. Owners should maintain open lines of communication with Rent Baguio regarding any changes, updates, or issues related to the properties or guests.
  2. Owners should cooperate with Rent Baguio in providing the necessary information or documentation required for booking or resolving any guest-related matters.

 

Insurance:

 

  1. Owners are encouraged to obtain appropriate insurance coverage for their properties to protect against potential damages or liabilities.
  2. It is the owners’ responsibility to ensure that their insurance coverage includes short-term vacation rentals and guests’ activities.

 

Compliance with Laws and Regulations:

 

  1. Owners must comply with all applicable laws, regulations, and ordinances, including those related to property rental, taxation, and health and safety standards.

 

Termination of Agreement:

 

  1. Either party may terminate this agreement by providing written notice to the other party.
  2. Upon termination, any existing reservations and obligations shall be fulfilled, and both parties shall settle any outstanding payments or refunds as per the terms of this agreement.

 

To include information about penalties being issued in the NDA agreement, you can add the following clause:

 

Penalties for Violations:

 

  1. In the event of a violation of any of the terms and conditions stated in this agreement, the Owner acknowledges and agrees to the imposition of penalties.
  2. The penalties for violations shall be determined by Rent Baguio at its sole discretion, taking into consideration the nature and severity of the violation.
  3. The Owner understands that penalties may include, but are not limited to, monetary fines, suspension of services, termination of the agreement, and any other appropriate actions deemed necessary by Rent Baguio.
  4. The Owner agrees to promptly pay any imposed penalties within the specified timeframe, as communicated by Rent Baguio.
